The Service is provided by OTA2U.COM , and relates to delivery of mobile content for personal use on your mobile phone handset.
You acknowledge that You are only entitled to use the Service for lawful purposes, for your own personal, private use and will not use the Service
in breach of any third parties intellectual property rights in the Service.
You recognise that the Service may, from time to time, be adversely affected by events outside our control.
We will make all reasonable endeavours to ensure the uninterrupted and timely supply of the Service and will take all reasonable steps at our expense
to correct any error, omission or mistake, but will be under no liability for any error in, or delay in, or failure in transmission of the Service.
In addition, the Service is subject to the limitations of the enabling technology on which it is reliant and may be adversely affected by network
performance and other operational factors beyond Our control, including without limitation, congestion, network coverage, dropped connections, the
performance of Your wireless device and the maintenance of secure network connections. We accept no responsibility if You do not receive the Service
for any of these reasons. These terms and conditions will not affect Your statutory rights.
In no event shall We be liable for indirect, incidental or consequential damages, including, without limitation, loss of income, data, or other
information, even if we have been advised of the possibility of such damages. In no event shall our liability exceed the price paid for the Service.
We shall not be held liable for any liability resulting from the use of the Service outside the United Kingdom and You agree to indemnify Us for
any loss or damage suffered by the Us as a result of the Service being used outside the United Kingdom.
In addition We will not be liable to You in any way for failures, defects or delays in the delivery of the Services which are caused by one or more
of the following reasons:
- You have provided an incorrect phone number or other incorrect
information before ordering a Service
or Product.
- Your phone does not support the Service or Product.
- Your message mail box is full and has no additional memory
to receive the download
- You accidentally make multiple orders for the same content
- Your phone is out of range or for some other reason can
not be contacted
- You accidentally erase a Service provided to You
- You supply any material or instructions which are incomplete,
incorrect, inaccurate, illegible or in the wrong form
You agree that Your personal data supplied when making an order for the Service
may be used by Us to monitor the use of the Service and from time to time
to evaluate if we can improve the Service for customers.
We do not give refunds for orders placed that have been sent to incompatible mobile phones or for WAP connectivity issues.
